Injured in an Uber or Lyft? Understanding Rideshare Insurance

Overview Summary

  • 1Uber/Lyft cases are complex because insurance coverage depends on the driver's 'status' (App On/Off).
  • 2If the driver has a passenger (Period 3), there is a $1 Million policy available.
  • 3If the app is off, only the driver's personal insurance applies (which might deny coverage for commercial use).
  • 4Passengers are almost never at fault.
  • 5You can sue both the rideshare company and the other driver involved.

Rideshare accidents are not like regular car accidents. There is a complex web of insurance policies depending on exactly what the driver was doing at the second of impact.

The 3 Periods of Coverage

  • Period 0 (App Off): Driver is just a regular person. Only their personal insurance applies.
  • Period 1 (App On, Waiting): Driver is logged in but has no ride. Limited coverage (usually 50k/100k) applies.
  • Period 2 & 3 (En Route / Passenger in Car): Full coverage. Uber/Lyft provide a $1 Million liability policy and $1 Million UM/UIM coverage.

Rights of the Passenger

If you are a passenger, you are in the best position legally. You are innocent. We can trigger the million-dollar policy to ensure your medical bills are fully covered, regardless of which driver caused the crash.
